1. About VideoMart

VideoMart is a Transactional Video-On-Demand (TVOD) platform that allows creators, educators, and filmmakers to monetize their content directly through pay-per-view and subscription-based models. VideoMart is operated by Videomart Technologies Private Limited.

2. Eligibility & Account Registration

• You must be at least 18 years old to create an account.
• You agree to provide accurate, current, and complete information during registration.
• You are solely responsible for maintaining the confidentiality of your login credentials.
• VideoMart reserves the right to suspend or terminate accounts found violating these Terms.

4. Content Ownership & Licensing

• Creators retain full ownership of the content they upload.
• By uploading content, creators grant VideoMart a non-exclusive, worldwide, royalty-free license to host, stream, distribute, promote, and display the content on the Platform.
• Creators confirm that they own or legally control all rights to the uploaded content.
• Uploading content without proper rights, licenses, or permissions is strictly prohibited.

5. Prohibited Content

You may not upload, publish, or distribute:

• Pirated or stolen content
• Content infringing copyright, trademark, or IP rights
• OTT platform rips or YouTube rips
• Pornographic, sexually explicit, or illegal material
• Content promoting hate, violence, or unlawful activity

Violation may result in content removal, account suspension, permanent bans, and legal action.

6. Copyright Policy & Enforcement

VideoMart follows a strict copyright enforcement policy, including:

• AI-based content detection
• Manual moderation
• User and rights-holder reporting

Copyright claims, counterclaims, dispute resolution timelines, penalties, and repeat violation consequences are handled as per VideoMart's Copyright Policy.

False or abusive copyright claims may result in penalties against the complainant.

• All purchases are final.
• No refunds will be issued once a video is streamed or accessed.
• Refunds may be granted only in cases of technical failure attributable to VideoMart.

9. VideoMart Authority Score (VAS)

VideoMart uses an internal ranking system known as VideoMart Authority Score (VAS) to determine content visibility and creator ranking.

VAS is influenced by:

• Content quality
• Upload consistency
• Watch time & engagement
• User ratings & reviews
• Copyright strikes

VideoMart does not guarantee visibility, ranking, or revenue.

10. Platform Availability & Modifications

• VideoMart may modify, suspend, or discontinue any part of the Platform at any time.
• Features, pricing, algorithms, or policies may change without prior notice.

11. Termination

VideoMart reserves the right to:

• Suspend or terminate accounts
• Remove content
• Forfeit earnings

12. Disclaimer of Warranties

• The Platform is provided "as is" and "as available."
• VideoMart does not guarantee uninterrupted service, error-free operation, or financial success for creators.

13. Limitation of Liability

To the maximum extent permitted by law, VideoMart shall not be liable for:

• Loss of revenue or profits
• Content takedowns
• Account suspension
• Data loss
• Indirect or consequential damages

14. Indemnification

You agree to indemnify and hold harmless VideoMart, its directors, employees, and partners from any claims arising from:

• Content you upload
• Violation of these Terms
• Infringement of third-party rights

15. Governing Law & Jurisdiction

• These Terms are governed by the laws of India.
• Any disputes shall be subject to the exclusive jurisdiction of courts located in India.

16. Changes to These Terms

VideoMart may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the revised Terms.
